ASK-DOCTORS.COM TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of Ask-Doctors.com ("Platform"), operated by SWISS AYURVEDA PRIVATE LIMITED ("Company"), registered in India under CIN U86901MP2024PTC073695, with its registered office at H. No. 186, Bhel, Bhopal, Huzur, Madhya Pradesh, India, 462022.
By accessing or using the Platform, you agree to these Terms. If you do not agree, please discontinue use immediately.
1. Nature of the Service
- The Platform is an IT-based solution that facilitates interactions between Users and independent allopathic medical practitioners ("Doctors").
- The Company does not provide medical services, diagnoses, or treatment directly. It acts as a technological intermediary and not a healthcare provider. It allows Users to interact with licensed allopathic doctors for general medical guidance.
- The Company acts solely as a technological intermediary and bears no liability for the accuracy, quality, or consequences of medical consultations. The Platform does not offer telemedicine services or any diagnostic treatments that require compliance under India’s telemedicine regulations. All advice given by the doctors on the Platform is general guidance, and Users are advised to consult with in-person healthcare providers for proper diagnosis and treatment.
- Users acknowledge that they are consulting with independent medical professionals, and the Company does not assume responsibility for the medical advice provided on the Platform. The Company does not assume responsibility for the accuracy, quality, or consequences of medical advice or recommendations provided by the doctors.
2. User Eligibility
- Users must be 18 years or older to register and use paid services.
- Users must provide accurate and truthful personal information during registration.
- The Company reserves the right to terminate accounts that provide false information or violate these Terms.
3. Doctor Responsibilities
- Doctors must provide valid medical credentials and certifications during registration and ensure their information remains up to date.
- Doctors bear full and sole responsibility for the medical advice, diagnosis, and treatment plans they provide.
- The Company verifies documents but does not certify, endorse, or guarantee the qualifications or expertise of Doctors.
- Any legal or medical disputes between Doctors and Users must be resolved independently, and the Company is not a party to such disputes.
4. Payments and Fees
- The Platform facilitates both free and paid consultations.
- Payments are processed through the Platform’s integrated payment system.
- The Company retains a commission from each paid consultation before transferring the remainder to the Doctor.
- The Company is not responsible for financial disputes between Users and Doctors regarding payments or refunds.
- Payments are final and non-refundable, except in cases of service non-fulfillment or technical errors.
5. Limitation of Liability
- The Company is not responsible for any medical opinions, treatment decisions, or health outcomes resulting from consultations or advice provided by doctors on the Platform.
- Users assume full responsibility for their medical decisions and should seek a second opinion from an in-person medical provider when necessary.
- The Company is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Platform.
- Doctors agree to indemnify and hold harmless the Company from any claims, disputes, or liabilities related to their medical advice or services.
6. User Conduct and Restrictions
- Users must not use the Platform to:
- Post false, misleading, or defamatory content.
- Engage in fraudulent or illegal activities.
- Violate intellectual property rights.
- The Company reserves the right to remove content or suspend accounts violating these terms.
7. Privacy and Data Protection
- User data is collected, stored, and processed in accordance with the Privacy Policy.
- The Company does not sell or share personal data with third parties without consent.
- Users have the right to access, correct, or delete their personal data in compliance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023 (DPDPA).
- The Company is committed to securing user data in accordance with applicable laws and regulations, ensuring that all data processing activities comply with the DPDPA, including the secure handling and storage of health-related and sensitive personal data.
- The Company is not responsible for any unauthorized access, data breaches, or third-party misuse of User information.
8. Termination of Services
- The Company reserves the right to suspend or terminate any User’s account for violating these Terms.
- Users may delete their accounts by submitting a request to info@ask-doctors.com.
9. Governing Law and Dispute Resolution
- These Terms are governed by the laws of India.
- Any disputes shall be resolved through negotiation and arbitration under the jurisdiction of courts in India.
- The Company shall not be liable for any international legal claims arising from use of the Platform outside India.
10. Changes to These Terms
- The Company reserves the right to modify these Terms at any time.
- Continued use of the Platform after modifications constitutes acceptance of the updated Terms.
