ASK-DOCTORS.COM TERMS AND CONDITIONS FOR PRODUCTS AND SERVICES

These Terms and Conditions ("Agreement") govern the use of products and services offered on Ask-Doctors.com ("Platform"), operated by SWISS AYURVEDA PRIVATE LIMITED ("Company"), registered in India under CIN U86901MP2024PTC073695, with its registered office at H. No. 186, Bhel, Bhopal, Huzur, Madhya Pradesh, India, 462022.
By purchasing or using any products or services on the Platform, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.
1. Scope of Services
- The Platform provides access to medical consultations, digital health services, and related products in the field of allopathic medicine.
- The Company does not manufacture, sell, or endorse any pharmaceutical or medical products directly. Any products offered through the Platform are sold by third-party vendors (eg. pharmacies) who are responsible for the sale and delivery of such products.
- The services are intended for informational purposes only and do not substitute professional in-person medical treatment or diagnosis. The Platform connects Users to licensed allopathic doctors who provide general medical advice and guidance.
2. User Eligibility
- Users must be 18 years or older to purchase or use paid services.
- Users must provide accurate and truthful personal information during registration and transactions.
- The Company reserves the right to terminate or suspend accounts that provide false information or violate these Terms.
3. Pricing and Payments
- Prices for products and services are listed in the applicable currency.
- Payments must be made through the Platform’s integrated payment system.
- The Company retains a commission from paid consultations before transferring the remainder to the Doctor.
- All payments are final and non-refundable, except in cases of technical errors, service non-fulfillment, or duplicate transactions made in error.
4. Refund and Cancellation Policy
- Refunds are only granted under the following conditions:
- The service was not provided due to technical issues.
- The assigned Doctor was unavailable or failed to deliver the consultation.
- Any duplicate transactions made in error.
- Refund requests must be submitted to info@ask-doctors.com within 7 days of the transaction.
- The Company reserves the right to approve or deny refund requests at its sole discretion.
5. Product and Service Liability
- The Company does not warrant or guarantee the effectiveness of medical consultations, products or services.
- Users acknowledge that medical consultations provided on the Platform are not a substitute for in-person professional medical treatment, diagnosis or prescription.
- The Company is not responsible for any adverse effects or health outcomes resulting from the use of the services, consultations, or any products offered through the Platform.
6. Intellectual Property
- All content, branding, and materials related to the Platform are the property of the Company and are protected by intellectual property laws.
- Users may not reproduce, distribute, or exploit any content from the Platform without prior written consent from the Company.
7. Privacy and Data Protection
- User data is collected, stored, and processed in accordance with the Privacy Policy.
- The Company does not share or sell personal data to third parties without explicit consent from the User, except as required by law.
- The Company is committed to complying with applicable data protection laws, including the Digital Personal Data Protection Act, 2023 (DPDPA), to ensure secure handling, processing, and storage of personal and sensitive data.
- Users have the right to access, correct or delete their personal data stores on the Platform, in compliance with the DPDPA.
8. Termination of Services
- The Company reserves the right to terminate or suspend a User’s access if:
- They violate these Terms.
- They engage in fraudulent or abusive behavior.
- Users may cancel their accounts by sending a written request to info@ask-doctors.com.
9. Dispute Resolution and Governing Law
- This Agreement is governed by the laws of India.
- Any disputes shall be resolved through negotiation and arbitration under the jurisdiction of courts in India.
- The Company shall not be liable for any international legal claims arising from the use of the Platform outside India.
10. Modifications to this Agreement
- The Company reserves the right to modify these Terms at any time.
- Continued use of the Platform after modifications constitutes acceptance of the updated terms.
