ASK-DOCTORS.COM DATA PROTECTION AGREEMENT
Effective Date: 25th November, 2024
This Data Protection Agreement ("Agreement") is entered into by and between SWISS AYURVEDA PRIVATE LIMITED ("Company"), registered in India under CIN U86901MP2024PTC073695, with its registered office at H. No. 186, Bhel, Bhopal, Huzur, Madhya Pradesh, India, 462022, and all users ("Users") of Ask-Doctors.com ("Platform").
By using the Platform, you agree to comply with this Agreement. If you do not agree, please discontinue use immediately.
1. Purpose and Scope
- This Agreement governs the processing, protection, and security of personal data collected through the Platform.
- The Company is committed to complying with applicable data protection laws, including but not limited to Indian Information Technology Act, 2000, Digital Personal Data Protection Act, 2023 (DPDPA) and, where applicable, General Data Protection Regulation (GDPR) for EU users.
- This Agreement applies to all personal data collected from Users and Doctors.
2. Types of Data Collected
- Personal Information: Name, email, phone number, account details.
- Wellness related Information: Health-related information voluntarily shared with Doctors.
- Financial Information: Payment details processed through third-party providers.
- Technical Information: IP address, browser type, device details, and session logs.
3. Data Processing and Usage
- Personal data is collected solely for the purpose of providing platform services related to wellness consultations and educational content.
- Data is processed based on user consent, contractual necessity, and legal obligations.
- The Company does not sell or rent user data to third parties.
- Data may be used for platform improvements, security, compliance, and customer support.
4. Data Retention and Deletion
- Personal data is retained only as long as necessary for service provision and legal compliance.
- Users may request data deletion via email at info@ask-doctors.com.
- Upon account termination, the Company will anonymize or delete personal data, except where required for compliance.
5. User Rights and Controls
Users have the right to:
- Access their personal data.
- Correct or update inaccurate information.
- Request deletion of their data.
- Withdraw consent for data processing.
- File a complaint with relevant data protection authorities.

6. Data Security Measures
- The Company implements industry-standard security measures to protect personal data.
- Security measures include encryption, secure storage, and access controls.
- In the event of a data breach, affected Users will be notified as required by law.
7. Third-Party Processors
- Payments and certain analytics services are managed by third-party providers.
- These providers adhere to their own privacy policies, which Users should review.
- The Company is not responsible for data handling by third-party services.
8. Compliance with GDPR (For EU Users)
- Users based in the EU have additional rights under GDPR, including:
- The right to data portability.
- The right to restrict processing.
- The right to be informed about automated decision-making.
- The Company appoints a Data Protection Officer (DPO) to oversee GDPR compliance.
- EU Users may file complaints with their respective Data Protection Authority (DPA).
9. Compliance with DPDPA, 2023 (For Indian Users)
In compliance with the Digital Personal Data Protection Act, 2023 (DPDPA, 2023):
- Consent Management: Users’ consent is obtained before processing personal data.
- Data Minimization: Personal data will only be collected and processed for legitimate and specific purposes.
- Data Localization: The Company ensures that data is processed and stored in compliance with Indian regulations.
- Right to be Forgotten: Users can request the deletion of their data, subject to exceptions under the DPDPA, 2023.

10. Changes to this Agreement
- The Company reserves the right to modify this Agreement at any time.
- Continued use of the Platform after modifications constitutes acceptance of the updated terms.
11. Governing Law and Dispute Resolution
- This Agreement is governed by the laws of India.
- Disputes shall be resolved under the jurisdiction of courts in India.
- EU Users may also seek remedies under GDPR enforcement mechanisms.
